Family Dispute Resolution is a specialised type of mediation aimed to help parties come to an agreement regarding the custody of their children, or separation of their assets.



Do you really need to go to court?

The process of going through the Family Court is stressful, expensive and time consuming. Family Dispute Resolution (FDR) is quicker, cheaper and in most cases less stressful. It also helps preserve the relationship between the parties, which is extremely important where they will be co-parenting the children together for years to come.

The Family Dispute Resolution Practitioner (FDRP) is an independent and neutral third party whose role is to facilitate the discussion in a safe, structured environment. Attendance at FDR is now mandatory under the Family Law Act 1975 (Cth) before a party may make an application to the Court regarding a parenting (custody) matter.

The Family Court will require a section 60i certificate by a registered FDR practitioner confirming attendance at FDR before they accept an initiation application.

NB: FDR or mediation is not suitable in every set of circumstances and in some instances the section 60i certificate may reflect this fact.

While there is currently no certificate required for property/financial settlement, the Court will still require the parties to complete pre-action procedures before proceeding to Court. These procedures can be undertaken during FDR. In fact, the complete property settlement process can be achieved at FDR / mediation when both parties are amenable.
